Keeping Families Together: An Update on the Parole in Place Program

The Keeping Families Together program, also known as Parole in Place, launched on August 19, 2024, with the goal of helping certain spouses and children of U.S. citizens apply for lawful permanent residency without leaving the country. However, recent legal challenges have put the program on hold. Here's what you need to know about the current situation.

  • On September 11, 2024, the United States Court of Appeals issued an order suspending the program;
  • Oral arguments are scheduled for October 10, 2024, and no changes to the program can be implemented until the appeals court makes a decision or issues a new order;
  • While the Department of Homeland Security cannot approve applications at this time, they can still accept them.   

What This Means for Applicants 

Despite the ongoing legal challenges, applicants are generally still encouraged to apply. Firstly, applications are still being accepted, even though they cannot be approved until the program resumes. Secondly, filing now could secure your place in line if the program resumes. Lastly, having an application on file might be beneficial if the program undergoes changes in the future. Remember that similar programs have faced challenges before but often continue in some form.

If you're concerned about the Parole in Place program's uncertainty, you might want to consider the I-601A waiver as an alternative. This application allows certain individuals who are inadmissible due to unlawful presence to apply for a waiver while still in the U.S. This process can reduce the time spent apart from family during the immigration process.
