Common Reasons to File an Appeal
An appeal does not need to be related to deportation either -- there are many reasons why one may file an appeal:
- Application for citizenship through naturalization was denied
- Application for waiver of ground of inadmissibility was denied
- Denied visa petition
- Letter from USICS with Notice of Intent to Deny
About the Board of Immigration Appeals
One of the most common ways in which our law firm can pursue appellate immigration work is through the Board of Immigration Appeals (BIA), which is the highest administrative body regarding immigration law. In most cases, appeals brought to the BIA are conducted via a "paper review"; however, in some cases, the BIA may hear an oral argument—usually at their Falls Church headquarters. It is the BIA's responsibility to hear appeals for decisions from immigration judges and the Department of Homeland Security's district directors.
About the Appeals Process
If you are not satisfied with an immigration judge’s decision or you are facing deportation, you have the opportunity to appeal the decision. You may start by filing a Notice of Appeal within 30 days. If it not received by the Board of Immigration Appeals within 30 days, then the immigration judge’s decision will become final.
Below is a quick run through of the immigration appeals process:
- Board of Appeals (BIA) receives your Notice to Appeal (NOA)
- BIA sends you a receipt of NOA with:
- Transcription of the judge's original decision
- Briefing schedule with a deadline date
- Return the brief by the deadline date
- BIA reviews the brief and comes to a decision within 1 - 2 months
